New Jersey Cannabis Laws for Adults 21+

Who can buy

Anyone 21 or older, New Jersey residents and visitors alike, with a valid government-issued photo ID, at a state-licensed dispensary. It’s illegal for anyone under 21 to buy, have or use cannabis.

How much you can buy

Each purchase can include up to the equivalent of 1 ounce (28.35 grams) of cannabis. That means up to:

• 28.35 grams (1 ounce) of dried flower, or
• 4 grams of concentrate or resin, or
• 4 grams of vape oil, or
• 1,000 mg of edibles (for example, ten 100 mg packages).

You can also combine products, for example ½ ounce of flower plus 2 grams of concentrate.

How much you can have

Adults 21+ may have up to 6 ounces of cannabis and cannabis products. You can give up to 1 ounce to another adult 21+, as long as you aren’t paid or compensated for it.

Where you can use it

• On private property, but property owners and landlords can prohibit it.
• Smoking is allowed only where cigarette smoking is allowed, unless posted otherwise.
• Not on federal land or in federal buildings.
• Not in public spaces where smoking is banned.
• Not in our store or our parking lot.

Driving

Impaired-driving laws apply to cannabis. The consequences are the same as for alcohol. Don’t drive after using cannabis; plan a ride.

Travel and mail

It’s illegal to take cannabis across state lines in any amount, even to a state where it’s legal, and you can’t mail it.

• Home growing isn’t allowed under New Jersey law.
• At work, employers can prohibit cannabis.
• Your privacy: dispensaries must check your ID but can’t copy it or keep a record of your purchase beyond what the transaction requires.
